Welcome to BabyBlueWhales.
We are passionate about children’s development and creativity. Our brand began with educational posters and flashcards designed for our own daughter, and we continue to create products that combine learning with home decoration — true to our motto: “Make education a decoration.”

These Terms and Conditions govern the use of our website (the “Site”) and set out the terms on which we supply our personalized and made-to-order products (the “Products”). By accessing the Site and/or placing an order, you agree to be bound by these Terms and Conditions. If you do not agree, you should not use the Site.

We may update these Terms and Conditions from time to time. Continued use of the Site after changes are posted will constitute acceptance of the revised Terms.

1. Definitions

  • Buyer: The person placing an Order.

  • Order: A request for Products placed via the Site.

  • Contract: The Order and Order Confirmation issued by BabyBlueWhales.

  • Price: The price of the Products, including shipping costs and any applicable taxes, unless otherwise stated.

  • Products: Kids’ educational and decorative products (such as posters, flashcards, and similar items), many of which can be customized with a child’s name, supplied by BabyBlueWhales.

2. Access and Use of the Site

You agree not to use the Site in any unlawful manner or in breach of applicable regulations. When placing an Order, you must provide accurate details including your name, delivery address, and contact information. For Products that allow personalization, you may supply a name to be included in the design. BabyBlueWhales does not accept customer-provided artwork, images, or logos for printing.

3. Intellectual Property

All intellectual property rights in the Site, our product designs, and related materials remain the property of BabyBlueWhales or its licensors. You may not reproduce, copy, or distribute Site content except for personal, non-commercial use.

4. Orders and Specifications

  • All Products are offered for sale subject to availability and our acceptance of your Order.

  • Most of our Products are made-to-order, and we do not keep stock. Customers should allow for production lead times.

  • Orders are confirmed only when we issue an Order Confirmation.

  • For Products with name personalization, it is your responsibility to ensure that the spelling of the name provided is correct.

5. Pricing & Payment

  • Prices may change at any time before your Order is confirmed.

  • Payment is required at the time of Order through our designated payment providers.

  • You confirm that all details provided for payment and delivery are accurate and that you have sufficient funds or credit to cover the Order.

  • For international orders, the Buyer is responsible for any import duties, customs charges, or taxes applied in the destination country.

6. Production & Delivery

  • Standard production time is 7–10 business days after Order confirmation.

  • Delivery timelines vary by destination:

    • Asia: 5–10 business days

    • Europe & US: 7–14 business days

    • Other regions: 10–20 business days (availability depends on supported countries).

  • All shipments are trackable. Delivery times are estimates and not guaranteed.

  • If a package is undeliverable due to an incorrect address or unpaid import duties, it will be returned at your cost. Reshipping fees apply if you wish to resend.

  • Risk of loss passes to you upon delivery. Title of the Products passes only once full payment has been received.

7. Returns, Refunds & Cancellations

  • As all Products are customized or made-to-order, Orders cannot be cancelled once production has started, except in cases of defective or faulty Products.

  • To make a claim for a faulty Product, you must provide a video recording of the unboxing process clearly showing the defect upon first opening the package. Without such proof, we cannot process a replacement or refund.

  • Claims for damage in transit must be filed directly with the courier. Please check parcels on delivery and note any visible damage with the courier.

  • Except as required by law, we do not provide refunds for personalized or made-to-order Products.

8. Liability

  • We warrant that our Products are of satisfactory quality and suitable for their intended purpose.

  • To the extent permitted by law, our liability is limited to the value of the Order.

  • We are not liable for indirect, incidental, or consequential losses, including lost profits, business interruptions, or data loss.

  • We are not responsible for delays or failures caused by events outside our reasonable control, including strikes, transport disruptions, or natural disasters.

9. Indemnity

You agree to indemnify and hold harmless BabyBlueWhales, its employees, and affiliates from any claims, damages, or expenses arising from information you provide (including name personalization) or from your breach of these Terms.

10. Termination

We may suspend or terminate access to the Site or cancel an Order if you breach these Terms or if required by law.

11. Data Protection & Privacy

Your personal information will be collected and used in accordance with our Privacy Policy, which forms part of these Terms.

12. Governing Law

These Terms and Conditions shall be governed by and construed in accordance with the laws of Thailand, and disputes shall be subject to the exclusive jurisdiction of the courts of Thailand.
